Clear terms for an early product.

These terms govern the private-testing release of Nexamas SmartBookmarks. They describe the current service boundaries without reducing mandatory consumer rights under German or European law.

1. Provider

2. Product and testing status

SmartBookmarks is a browser-extension product for organizing bookmarks and browser sessions, with optional identity and encrypted cloud backup. The current release is under private owner testing and is not a public store offering. Product behavior, availability and supported environments may change before public release.

3. Permitted use

Users may use the product for lawful personal or professional bookmark and session management. Users must not attempt to compromise the service, bypass security or rate limits, access another person's account or cloud data, distribute malicious modified builds under the Nexamas name, or use the service in violation of applicable law or provider terms.

4. Local data and backups

The local library is primarily stored in the browser environment. Users are responsible for maintaining access to their device, browser profile, exported backups and Recovery Key. Encrypted synchronization is an optional recovery mechanism, not a guarantee against all loss.

The Recovery Key may be the only way to decrypt a cloud vault after a new installation. Nexamas cannot recover a lost key because the key is not stored by the Nexamas account service.

5. Third-party services

Optional sign-in and synchronization depend on services operated by Google, Microsoft, Cloudflare, Resend, Fastmail and potentially browser vendors. Their availability, policies, account restrictions and terms apply independently. Nexamas is not responsible for outages or account decisions controlled solely by those providers, but will take reasonable care in integrating their services.

6. Accounts and security

Users must keep access to their email, Google or Microsoft account secure and promptly report suspected unauthorized access. Nexamas may revoke sessions, limit requests or suspend access when reasonably necessary to protect users, prevent abuse or comply with law.

7. Account deletion and uninstalling

Account deletion, cloud-vault deletion and browser-local deletion are distinct actions. The in-product account-deletion flow is designed to remove the selected encrypted cloud vault before deleting the Nexamas identity and sessions. The local library remains unless separately removed. Uninstalling the extension alone does not necessarily delete the Nexamas account or cloud vault.

8. Availability, changes and support

Nexamas aims to provide a dependable product but does not promise uninterrupted availability during private testing. Features, interfaces and supported providers may be corrected or changed. Material changes affecting privacy or user obligations will be documented appropriately.

9. Warranty and liability

Nothing in these terms excludes liability that cannot legally be excluded, including liability for intent, gross negligence, injury to life, body or health, product-liability obligations, or mandatory consumer rights. For other loss during the free private-testing period, liability is limited to the extent permitted by applicable German law.

Users should retain independent copies of important data and must not rely on a single browser profile or a single Recovery Key location.

10. Governing law

German law applies, excluding conflict-of-law rules, to the extent this choice does not deprive consumers of mandatory protections of their country of habitual residence. Statutory venues and consumer-dispute rights remain unaffected.

Nutzung und Verantwortung

Die Erweiterung darf für rechtmäßige private oder berufliche Zwecke verwendet werden. Der Nutzer ist für die Sicherheit seines E-Mail-, Google- oder Microsoft-Kontos sowie für die sichere Aufbewahrung des Recovery Keys verantwortlich. Da Nexamas den Recovery Key nicht speichert, kann ein verlorener Schlüssel grundsätzlich nicht wiederhergestellt werden.

Drittanbieter und Verfügbarkeit

Optionale Funktionen hängen von Google, Microsoft, Cloudflare, Resend, Fastmail und dem Browseranbieter ab. Während der Testphase können Funktionen geändert oder zeitweise nicht verfügbar sein. Zwingende gesetzliche Verbraucherrechte und die gesetzlich nicht ausschließbare Haftung bleiben unberührt.

Löschung

Deinstallation, lokale Datenlöschung, Cloud-Vault-Löschung und Kontolöschung sind getrennte Vorgänge. Die Kontolöschung soll zuerst die verschlüsselte Cloud-Vault entfernen und anschließend die Nexamas-Identität löschen. Die lokale Bibliothek bleibt erhalten, sofern sie nicht gesondert gelöscht wird.
